Terms of Use
These terms govern your use of the Cohesys website, our published material, and any Website Intelligence Report or Digital Business Index™ score we provide.

1. Acceptance
These Terms of Use form an agreement between you and Cohesys. By accessing or using this website you accept them. If you do not accept them, please do not use the website.
These terms are issued in English and Bahasa Malaysia. Both versions carry equal standing; if there is any inconsistency, the English version prevails.
2. Information on this website is not advice
The material on this website describes our services and our general view on technology delivery. It does not constitute technical, legal, financial, tax or other professional advice, and it does not take account of your particular circumstances. You should not act on it without obtaining advice appropriate to your situation.
3. Scope of services and relationship to the Master Services Agreement
Nothing on this website constitutes an offer capable of acceptance, a quotation, or a commitment to perform services. Descriptions of our services are indicative only.
Any engagement is governed exclusively by the Master Services Agreement, statement of work, proposal or other written contract executed between Cohesys and the client, which sets out scope, deliverables, fees, service levels, warranties and liability. Where those documents conflict with this website, the executed contract prevails.
4. Website Intelligence Reports and the Digital Business Index™
The Digital Business Index™ is a proprietary analytical estimation generated by Cohesys based on automated testing and publicly accessible domain metrics. Scores and rankings are provided for informational and preliminary commercial evaluation only and do not constitute a formal technical audit, legal advice, or financial assessment.
Any score, ranking, competitor comparison or sample report displayed on this website is illustrative and uses example data. It does not describe a real organisation and is not a representation about any identified business.
Scores reflect an assessment against our own published dimensions and weightings at the date of analysis, and competitor positioning reflects the comparison set selected for that report. Results may change as a website, its competitors or the underlying data sources change. We give no warranty that any commercial outcome will follow from acting on a report, and you remain responsible for decisions you take.
5. Intellectual property
All content, design, code, written material, report templates, scoring criteria, weightings and analytical methodology on this website or within our reports are owned by Cohesys or its licensors and are protected by copyright and other intellectual property rights.
The Digital Business Index™, together with its name, scoring model and methodology, is proprietary to Cohesys. No licence to use, reproduce, adapt, benchmark against or commercialise the methodology is granted by publication on this website.
Where we deliver a report to you, you receive a non-exclusive, non-transferable licence to use that report for your own internal business purposes. You may not resell it, publish it in whole or in substantial part, or present the methodology or index as your own without our prior written consent.
You may read, download and print pages of this website for your own internal and non-commercial reference.
6. Acceptable use
- Do not use this website in any way that breaches applicable law or regulation.
- Do not attempt to gain unauthorised access to this website, its servers, or any connected system or network.
- Do not introduce malicious code, or place unreasonable load on the website through scraping, automated querying or similar means.
- Do not submit another person's personal data through our forms without their knowledge and consent.
- Do not reproduce, resell or systematically extract material from this website for commercial purposes.
7. Third-party links
This website links to third-party sites, including sources cited in our Insights articles. Those sites are not under our control. We are not responsible for their content, availability or handling of your personal data, and a link does not imply endorsement.
8. Availability and disclaimers
We aim to keep this website available and accurate, but it is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free, or that content is complete or current at any given time. We may change, suspend or withdraw any part of it without notice.
9. Limitation of liability
To the maximum extent permitted by law, Cohesys shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill, business or anticipated savings, arising from or in connection with your use of this website or reliance on any score, ranking or report published on it.
To the maximum extent permitted by law, our total aggregate liability arising from use of this website is limited to one hundred Malaysian Ringgit (RM100). Liability arising from a client engagement is governed instead by the executed contract for that engagement.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.
10. Indemnity
You agree to indemnify Cohesys against claims, losses and reasonable costs arising from your breach of these terms, your misuse of this website, or your unlawful use of any report or score we provide.
11. Privacy
Personal data submitted through this website is handled in accordance with our Privacy Policy, which forms part of these terms.
12. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising out of or in connection with these terms or your use of this website.
13. Changes to these terms
We may revise these terms from time to time. The effective date shown on this page indicates the current version, dated 16 September 2026. Continued use of the website after a revision constitutes acceptance of the revised terms.
